Аннотация

Статья посвящена исследованию особенностей и специфики российской модели системы разделения властей. Определяются следующие принципиальные особенности системы разделения властей в Российской Федерации, которые отличают ее от традиционной модели: 1) во главе системы разделения властей находится Президент Российской Федерации, который де-юре не отнесен ни к одной из трех ветвей власти, но фактически является главой исполнительной власти; 2) недостаточно значим статус законодательной ветви власти; 3) судебная ветвь власти не обладает полной финансовой независимостью; 4) российская система разделения властей распространяется как на федеральный уровень, так и на уровень субъектов
Российской Федерации; 5) некоторые органы государственной власти не включены в систему разделения властей, а их статус в Конституции Российской Федерации отражен фрагментарно. Подчеркивается необходимость дальнейшего совершенствования российской модели разделения властей как путем принятия поправок к Конституции, так и посредством внесения изменений
в федеральное законодательство.

Abstract

The article is devoted to the study of the features and specifics of the Russian model of the separation-of-powers system. The principal features of the separation-of-powers system in the Russian Federation, distinguishing it from the traditional model, are determined: 1) the head of the separation-of-powers system is the President of the Russian Federation, who is de jure not assigned to any of three branches of power, but is actually the head of the executive branch; 2) the status of
the legislative branch is not significant enough; 3) the judicial branch lacks full financial independence; 4) the Russian separation-of-powers system extends both to the federal level and to the level of
the Russian Federation subjects; 5) some public authorities are not included in the separation-ofpowers system, and their status is reflected fragmentarily in the Constitution of the Russian Federation.
The necessity of the further improvement of the Russian separation-of-powers model through amendments to both the Constitution and the federal legislation, is emphasized.
