Abstract |
The degree of legal doctrine influence on the formation of criminal procedure regulations is considered. The actual use of the provisions of criminal procedure doctrine as the source (form) of criminal procedure law is recognized. Basing on the judicial practice, the practical impact of the following doctrine point is shown: “the termination of the criminal case (prosecution) against a person for the act committed by him (her) on non-rehabilitating grounds doesn’t entail a refusal to bring the same person to other types of legal liability for committing the same act”. It’s argued that the absence of corpus delicti was mentioned as rehabilitating ground. Active repentance, changes in the situation, the expiration of limitation periods of bringing to criminal liability, act of amnesty were mentioned as non-rehabilitating grounds. Reference to the judicial practice formed before 2003 shows a uniform understanding of the doctrine of grounds for termination of criminal case by the judiciary and active application of this doctrine in conditions of legislator’s silence. Until the end of 2002, the courts were guided by the provisions of procedural doctrine as a source of law when deciding on the occurrence of specific consequences, associated with the rehabilitation characteristics of the grounds for termination of the criminal case, for the person. The situation was changed when the RF Criminal Procedure Code came into force and relevant rules were fixed in chapter 18. So the legal rules passed from one source of law to another one, from legal doctrine to codified normative legal act. |
