Abstract

The issues of realization of the constitutional right to appeal decisions and actions (omission) of public authorities, local authorities and their officials are investigated. Normative legal acts, regulating the procedure of implementation of this constitutional guarantee in civil proceedings (Chapter 25 of the RF Civil Procedure Code), are analyzed. It’s stated that the resolution of the Plenum of the RF Supreme Court “On the practice of consideration the cases of appeals against decisions and actions (omission) of public and local authorities, officials, state and municipal employees by courts” doesn’t fully resolve the existing conflicts. The question concerning the correctness of including the analyzed procedure in civil proceedings, taking into account its public legal nature, is considered. The appropriateness of its inclusion in administrative proceedings is supported. Disputes in cases of appealing against decisions, actions (omission) of public and local authorities, officials, state and municipal employees are not civil and legal ones in its nature. Judicial proceedings in such cases is presented by the author as the evolution of previously existing procedural form and simultaneous unification (with separation) of the rules of consideration of this category of cases. It’s summarized that the adoption of the RF Administrative Procedure Code will ensure the effective implementation of Article 46 of the RF Constitution within the framework of administrative proceedings provided by Article 118. The evolution of procedural order of consideration of cases arising from public legal relations is seen as part of ongoing judicial reform and seems to be justified step in building a legal state.
