Abstract

An effective legal mechanism of maintaining law and order and preventing recidivism is an institution of administrative supervision, called in different years as police supervision or postcriminal supervision. Today prohibitions, temporary restrictions of the rights and freedoms, obligations imposed by the court towards persons being under administrative supervision, cannot completely solve the problem of growing crime recidivism. The reason is both imperfection of effective legislation and problems of law enforcement practice. The author proves the necessity to differentiate at the legislative level the understanding of categories “restriction” and “obligation” stipulated in the Federal law “On the administrative supervision over persons released from custody”. This aspect is conditioned by the fact that efficiency of the Russian law enforcement bodies’ activity in the sphere of preventing offences and crimes committed by recidivists depends on legislation quality. Successful realization of preventive activity depends to a great extent on consistency and clarity of statutory acts. The comprehensive perception of propositions on improving the effective legal framework by the legislator will give the institute of administrative supervision particular value and will favourably influence on its introducing into legal and social practice. The above mentioned problems of realization of administrative supervision have temporary character and they are connected with the necessity to reform the system of crime prevention. The institute of administrative supervision requires further development with the purpose of establishing conditions of full involvement of convicts into the society and maintaining law and order, preventing crimes committed by recidivists.
