Abstract |
The increase in crime organization, amount of weapon, corruption, crime globalization and intellectualization as well as in using latest achievements of science and technology is noted. It’s stated that the reform of criminal justice acquires complex and political character and requires appropriate reformation in all the spheres of social and political crime control. Detective means of crime investigation and detection are introduced into the sphere of criminal procedure regulation. The provisions of criminal procedure legislation of Ukraine, Kazakhstan, Georgia and Latvia, stipulating confidential (undercover) investigative actions are provided. There is a possibility of adopting these provisions by the Russian legislation (the first step to it implies procedural fixing of arrestment of post-and-telegraph sendings, their inspection and seizure, talks control and recording). The procedurality of the results of detective activity being not identical with the character of proceeding itself is admitted basing on the statements of other scientists studying this issue. Confidential procedural actions are not traditional, but very efficient when obtaining evidence. Introducing all the means of evidence obtaining into the procedure implies liberalization of criminal proceedings and guaranteeing of civil rights. The author proves the necessity to reconsider the effective norms within reasonable limits. It is stated that general procedurality of police activity contradicts the essence of detective activity. Non-procedural activity should supplement and accompany procedural one, but not substitute it. Regulation of independent generalized directions of obtaining evidential matter (verbal, material, electronic etc.) without going into procedural details of independent procedural actions, especially confidential, is more efficient. |
