Abstract |
The results of the survey of drug control operational units’ employees (125 respondents) concerning the apprehension of citizens while carrying out crime detection activities indicate the lack of appropriate legal grounds for the legality of such actions. Despite the practical need, normative acts don’t contain substantive and procedural rules, regulating the grounds, conditions, procedures, limits of this coercive procedure while carrying out crime detection activities. Despite the latency of the problem itself, the gap in normative regulation of apprehension can’t hide continuing legal conflict between officers of operational units and citizens apprehended by them. During such apprehension the rights to freedom and personal inviolability, freedom of movement, qualified legal assistance are limited de facto, without providing appropriate guarantees of observing rights and freedoms of man and citizen de jure. Existing legal regimes of apprehension don’t take into account the specificity of crime detection activities, and therefore can’t be applied for resolving these conflicts. In fact, the special legal regime of apprehension during crime detection activities exists (legal means of various branches of law), but it must be fixed by the rules of crime detection legislation, not because the apprehension is widespread in the activities of operational units, but because it’s carried out within the operational and detective competence for solving the problems of crime detection activities. It’s summarized that apprehension during crime detection activities can cover diverse situations and solve the problems concerning the authorities of officers of operational units (legal protection of professional interests) when observing rights and freedoms of citizens. |
