Abstract |
Establishing an independent judicial authority in cases of disputes of citizens with public authorities, its bodies and officials is considered as a current urgent task in Tajikistan. The most topical issues of administrative justice are analyzed: concept, content, nature, possible legal forms of its establishment in Tajikistan. Administrative justice is defined as an independent complex legal institution consisting of a set of legal rules fixing the system of specialized judicial bodies, the appropriate scope of their competence, the special judicial procedures to implement: 1) the functions of judicial control over decisions and acts (or omission) of public authorities, local authorities, public associations and officials; 2) the functions to protect the rights, freedoms and legitimate interests of citizens; 3) other functions of the judiciary. The need for selective reception of foreign experience while establishing administrative courts in the system of courts of general jurisdiction in Tajikistan is supported. The traditions of the Soviet (Russian) legislation development, gradually expanding the control functions of the courts in the sphere of administrative legal relations, are described. The experience accumulated by the courts of general jurisdiction, concerning consideration and resolution of this category of cases, available human resources, other existing conditions for the introduction of a separate administrative justice are stated. It’s summarized that at this stage of the Republic development it’s necessary to create a specialized administrative tribunal in the system of courts of general jurisdiction, designed to protect citizens’ rights and freedoms from violations by public authorities of executive power and their officials. |
